1. Functions of ADayASmile.com
ADayASmile.com accepting YOUR smiling picture at no cost. Every picture we collect from YOU will donate a RM1 to any of our prefereable charity organisation.
Unless otherwise stated, CharityMalaysia.com is hereby authorised by each charity listed on its website to collect donations on its behalf, subject to the terms and conditions contained in this Terms Of Service.
2. ADayASmile.com Undertakes the following duties:-
a. To provide an efficient online portal for raise funds to a particular chharity organisation.
b. To provide a convenient, economical and efficient way for YOU to send ADayASmile.com your picture to be listed on its website.
c. To remit funds (Picture) collected will be donated to the respective charities in a timely and efficient manner.
d. Register and renew the registration annually for the domain name.
e. Pay annual hosting charges for its domain name and data at the server.
f. To design and maintain a user-friendly and aesthetic website so as to encourage more online traffic to it.
g. To allow YOU to send YOUR picture and update ADayASmile.com website. However, we reserve the right to add, edit or delete any picture should we find it is unappropriate.
h. To pay for incidental costs for online marketing of its website.
i. Search Engine Optimiser
ii. Blogs
iii. E-forums
iv. E-zines
v. On-the-web Press Releases
vi. Article Submission
vii. Online newsletters
viii. Advertisement such as Google Adwords, Adsense, Yahoo, etc.
3. Any funds collected through sponsorship will be used for the following purposes:-
i. Staff salaries. Our founders and staff are currently on voluntary basis.
ii. Expenses and overheads. We intend to set up an offline centre to find a third party sponsor with cash and also to mobilise volunteers for various work around the country. We aim to be able to mobilise our own team to assist in emergency situations. Thus, we are raising funds for manpower, vehicles and equipment, etc.
4. Service Charge
Unlike most international professional fund-raising/donation sites, ADayASmile.com is a non-profit organisation. We do not levy any charges on donations made by donors. Nor do we charge charity organisations for our services.
5. User Conduct
a. YOU must at all times use the ADayASmile.com site and its associated services in a responsible and legal manner. You must not upload offensive, obscene or racist, sensitive, political or religious content, including photographs, on to the ADayASmile.com website.
b. It is YOUR responsibility to ensure that the images YOU uploaded to ADayASmile.com, particularly photographs, are not copyright-protected. If they are, you should obtain the copyright owner’s written consent to use it.
c. In addition, YOU as a user must not:-
i. misrepresent your identity or affiliation with any other person or organisation;
ii. use the website to send junk email or ’spam’ to people who do not wish to receive email from you;
iii. use the website to conduct, display or forward surveys, contests, pyramid schemes or chain letters;
iv. interfere with, or disrupt, the service or networks connected to the service.
d. Failure to comply with any of the above may result in ADayASmile.com suspending. You may be denied access to any or all parts of the site and services.
6. Termination
a. YOU may discontinue use of the site and services at any time. These Terms of Service will continue to apply to past use by YOU.
b. ADayASmile.com reserves the right to terminate its services to YOU with immediate effect and without assigning any reason whatsoever.
7. Other Terms And Conditions
Right To Amend This Terms Of Service
ADayASmile.com will make every effort to ensure that the website and other services are available continuously, but reserves the right to modify, suspend or discontinue all or any part at any time without notice. Unless specifically exempted, any new features, services or software applications introduced shall be subject to these Terms of Service.
ADayASmile.com reserves the right to modify or replace these Terms of Service at any time. Any change shall be effective immediately as it appears on the site. Each time you use the service you are deemed to have accepted any such change.

The ADayASmile.com website contains links to the websites of users and charity organisations. Inclusion of a link to another website does not imply endorsement of its content or opinions. YOUR relationship and any transactions with other organisations through their websites or otherwise are YOUR own responsibility.
b. Affiliate Services
ADayASmile.com may from time to time select partners or affiliates offering relevant information and services that we believe will enhance online traffic to our site. Whilst we will do our best to select partners of the highest integrity, we are not responsible for any aspect of the information or services offered by them, and if YOU choose to use their services YOU do so at YOUR own risk.
c. Trademarks
The name ADayASmile.com and any other product and service names that we may present on the site from time to time may not be used in connection with any product or service that does not belong to ADayASmile.com, nor in any manner that is likely to misrepresent or cause confusion, or in any way that may disparage or discredit ADayASmile.com. Other trademarks, service marks or logos that appear on the site are the property of their respective owners and are likely to be registered trademarks and subject to restrictions as to their use. They must not be used without the express permission of both ADayASmile.com and the trademark owner.
